These Terms of Service (“Terms”) govern your access to and use of flinthillsbarns.com and the products and services offered through the website.
Flint Hills Barns and Buildings Co. is operated by BJP Stores LLC, a Kansas limited liability company. In these Terms, “Flint Hills Barns,” “we,” “us,” and “our” refer to BJP Stores LLC doing business as Flint Hills Barns and Buildings Co.
By visiting the website, requesting a quote, creating an account, placing an order, paying an invoice, or otherwise using our services, you acknowledge that you have read and accepted these Terms.
Please also review our Privacy Policy, Shipping and Delivery Policy, Return and Refund Policy, Billing and Payment Terms, Website Disclaimer, and any product-specific terms applicable to your order.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order or use services requiring contractual acceptance.
If you act on behalf of a business, organization, trust, or other legal entity, you represent that you have authority to bind that entity.
2. Customer Accounts
Certain website features may require a customer account.
You agree to:
- Provide accurate, current, and complete information;
- Keep your account and contact information current;
- Maintain the confidentiality of your login credentials;
- Restrict unauthorized access to your account; and
- Notify us promptly if you suspect unauthorized activity.

Because we work with multiple manufacturers and suppliers, product information may change or contain supplier-provided errors. Variations may include:
- Dimensions and weight;
- Colors, materials, textures, and finishes;
- Doors, windows, roofs, trim, and hardware;
- Included components or accessories;
- Engineering ratings;
- Packaging;
- Availability;
- Manufacturing or delivery times; and
- Manufacturer warranty terms.
Photographs, renderings, floor plans, and lifestyle images may show optional upgrades, landscaping, furnishings, foundations, vehicles, animals, or accessories that are not included.
Written specifications, selected options, quotes, invoices, and order confirmations control over general images or promotional descriptions.
4. Measurements and Intended Use
Product dimensions, square footage, capacities, and clearances may be nominal or approximate unless expressly identified as exact.
Before ordering, you are responsible for confirming that the product is appropriate for:
- Your intended use;
- The available space;
- Property setbacks and clearances;
- Delivery access;
- The planned foundation or installation method;
- Applicable wind, snow, seismic, and structural requirements; and
- Local laws and property restrictions.
Do not begin permanent foundation work, utility installation, or site preparation using general website measurements alone. Use the final plans and specifications approved for your particular order.
5. Local Codes, Zoning, and Permits
Building codes, zoning requirements, permits, engineering standards, homeowner-association rules, easements, setbacks, and land-use restrictions vary by location.
Unless expressly included in a written agreement, you are responsible for determining and obtaining all required:
- Building and land-use permits;
- Zoning approvals;
- Engineering documents or stamped plans;
- Homeowner-association approvals;
- Inspections;
- Utility approvals;
- Contractor or trade permits; and
- Other governmental or property approvals.
A product’s advertised engineering or load rating does not automatically establish compliance at your property.
Contact your local authorities and qualified professionals before ordering when local approval or engineering is required.
6. Quotes and Custom Configurations
Quotes are estimates or offers based on the information available when issued. Unless the quote states otherwise, pricing, availability, freight charges, taxes, production schedules, and supplier terms may change before an order is accepted and payment is received.
Custom configurations must be reviewed carefully. You are responsible for verifying:
- Product dimensions;
- Colors and finishes;
- Door and window placement;
- Selected accessories;
- Engineering requirements;
- Delivery address;
- Site-access information; and
- All other listed options.
Once approved and released for procurement, customization, or manufacturing, a custom or special-order product may not be changed or canceled without additional charges—and may not be changeable or cancelable at all.
7. Orders and Acceptance
Submitting an order, quote request, or payment does not necessarily mean that we have accepted the order.
An order is accepted when we confirm acceptance, approve the transaction, or begin fulfillment, procurement, or production, as applicable.
We may reject, place on hold, or cancel an order because of:
- Product unavailability;
- Supplier limitations;
- Pricing or description errors;
- Delivery restrictions;
- Inadequate site access;
- Inability to verify customer or payment information;
- Suspected fraud or unauthorized activity;
- Legal or regulatory restrictions; or
- Another reasonable business or safety concern.
If we cancel an order after collecting payment, we will issue the refund required by applicable law and our posted policies.
8. Pricing and Errors
Prices may change before an order is accepted.
Although we make reasonable efforts to maintain accurate pricing, typographical, supplier, calculation, and technical errors may occur.
If we discover a material error, we may:
- Correct the information;
- Contact you with revised terms;
- Request approval before proceeding;
- Allow cancellation of the affected order; or
- Cancel the order and refund the affected payment.
We are not required to fulfill an order at an obviously incorrect price or according to a materially inaccurate description, subject to applicable law.
9. Payment
Payment terms are governed by our Billing and Payment Terms and any terms shown on the product page, quote, invoice, checkout page, or order confirmation.
Unless different terms are expressly approved in writing, payment is due when the order is placed.
Certain high-value, custom, or made-to-order products may require:
- A deposit;
- Progress payments;
- A remaining balance before shipment or delivery; or
- A separately approved payment schedule.
You agree to provide accurate billing and payment information and represent that you are authorized to use the selected payment method.
10. Taxes
Prices may or may not include sales, use, excise, or similar taxes, as stated on the product page, quote, or during checkout.
You are responsible for taxes associated with your purchase unless we are legally required to collect and remit them or the transaction qualifies for a documented exemption.
Customers claiming an exemption must provide valid documentation before the order is finalized. We may reject incomplete, expired, or legally insufficient exemption documentation.
11. Financing
Financing options, when available, may be provided by independent third-party lenders or financing platforms.
Financing approval, interest rates, repayment terms, fees, credit decisions, and eligibility are determined by the financing provider—not Flint Hills Barns and Buildings Co.
Your agreement with a financing provider is separate from these Terms. Unless expressly stated otherwise, failure to obtain financing does not automatically cancel an accepted order or eliminate charges already incurred.
12. Production and Fulfillment Times
Production, processing, shipment, and delivery dates are good-faith estimates unless expressly guaranteed in writing.
Timing may be affected by:
- Supplier inventory;
- Manufacturing schedules;
- Customization;
- Material availability;
- Freight scheduling;
- Weather;
- Transportation delays;
- Permitting;
- Site readiness;
- Customer-requested changes; and
- Events outside reasonable control.
When legally required, we will provide notice of a material shipment delay and offer the customer the applicable option to consent to the delay or cancel for a refund.
Do not schedule contractors, equipment rentals, travel, installation, or other time-sensitive commitments until delivery has been confirmed.
13. Shipping and Delivery
Shipping, freight, delivery, unloading, inspection, site-access, and damage-reporting requirements are governed by our Shipping and Delivery Policy and any product-specific delivery terms.
You are responsible for providing:
- A complete and accurate delivery address;
- A working telephone number and email address;
- Accurate access information;
- Notice of gates, bridges, narrow roads, overhead obstructions, soft ground, steep grades, or other hazards; and
- A safe, lawful, and reasonably accessible delivery location.
Additional charges resulting from inaccurate information, inaccessible property, failed delivery, customer delay, redelivery, storage, special equipment, or extraordinary site conditions may be your responsibility when disclosed and permitted by law.
Risk of loss, title, delivery responsibility, and remedies for loss or damage will be determined by the applicable Shipping and Delivery Policy, product-specific agreement, carrier terms, and governing law. Nothing in these Terms eliminates rights that cannot lawfully be waived.
14. Delivery Inspection and Damage
You or an authorized adult should inspect the shipment promptly upon delivery.
Visible shortages or damage should be:
- Noted on the delivery receipt before signing;
- Photographed clearly;
- Reported to the driver when possible; and
- Reported to us within the period stated in the Shipping and Delivery Policy.
Do not sign a delivery receipt stating that an order arrived in good condition if significant visible damage or missing components have been identified.
Failure to document visible freight damage promptly may affect the carrier’s claim process, but it does not eliminate rights that cannot legally be waived.
15. Site Preparation and Installation
Unless expressly included in writing, the customer is responsible for:
- Site preparation;
- Foundations, slabs, footings, or anchoring;
- Grading and drainage;
- Utility location and connection;
- Unloading equipment;
- Assembly and installation;
- Contractor coordination;
- Permits and inspections; and
- Ongoing maintenance.
Site conditions—including soil, slope, drainage, weather exposure, underground utilities, access limitations, and existing structures—may affect delivery, installation, performance, and cost.
General information on the website is not a substitute for manufacturer instructions, approved plans, or advice from a qualified contractor, engineer, electrician, plumber, or other licensed professional.
16. Independent Manufacturers, Carriers, and Installers
Some products and services are manufactured, supplied, shipped, delivered, or installed by independent third parties.
Unless expressly stated in writing, those parties are not employees of Flint Hills Barns and Buildings Co.
When we merely provide a referral or contact information, you are responsible for evaluating the provider’s:
- Qualifications;
- Licensing;
- Insurance;
- Experience;
- Pricing;
- Availability; and
- Suitability for your project.
Services purchased directly from an independent provider are governed by your agreement with that provider.
Services expressly sold by Flint Hills Barns and Buildings Co. are governed by the applicable quote, order confirmation, or service agreement.
17. Changes to an Order
Requested changes are not effective until confirmed in writing.
A change may result in:
- Additional charges;
- A revised production schedule;
- New freight or installation costs;
- Loss of previously selected options; or
- A requirement to submit a replacement order.
Changes may not be available after procurement, customization, engineering, manufacturing, packaging, or shipment begins.
18. Cancellations, Returns, and Refunds
Cancellations, returns, exchanges, and refunds are governed by our Return and Refund Policy and any product-specific terms accepted before purchase.
Custom, configured, personalized, special-order, made-to-order, installed, assembled, or clearance products may have limited cancellation or return eligibility.
A cancellation may be denied or reduced by disclosed, non-refundable costs already incurred, including:
- Supplier cancellation charges;
- Customization or engineering expenses;
- Manufacturing costs;
- Freight charges;
- Restocking fees; and
- Other order-specific expenses permitted by law.
Nothing in these Terms limits a cancellation, refund, warranty, or consumer right that cannot lawfully be excluded.
19. Warranties
Products may be covered by warranties issued by their manufacturers. Warranty coverage, duration, exclusions, maintenance requirements, claim procedures, and remedies vary by product.
You are responsible for reviewing the applicable warranty documentation and following required assembly, installation, anchoring, use, and maintenance instructions.
Flint Hills Barns and Buildings Co. does not disclaim or limit warranties or consumer remedies when doing so would violate applicable law. Nothing in these Terms replaces:
- A manufacturer’s express written warranty;
- A seller warranty expressly provided in writing;
- Product-specific warranty terms; or
- Non-waivable rights under applicable law.
20. Acceptable Website Use
You may use the website only for lawful purposes.
You agree not to:
- Attempt unauthorized access to the website, accounts, servers, or networks;
- Introduce malware, malicious code, or harmful technology;
- Interfere with website operation or security;
- Use automated systems to scrape or extract content without permission;
- Impersonate another person or submit false information;
- Use the website for fraud or unlawful activity;
- Circumvent purchase limits or security controls; or
- Infringe the rights of Flint Hills Barns, our suppliers, or another party.
We may restrict access when reasonably necessary to protect the website, customers, business, or third parties.
21. Intellectual Property
The website’s original text, branding, logos, graphics, page designs, and other original content are owned by or licensed to Flint Hills Barns and Buildings Co. and may be protected by intellectual-property laws.
Manufacturer names, product names, trademarks, photographs, specifications, diagrams, and other supplier materials remain the property of their respective owners.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the website for personal or internal business shopping purposes.
You may not reproduce, republish, distribute, sell, commercially exploit, or create derivative works from protected website content without appropriate permission or another lawful basis.
22. Reviews, Photographs, and Other Submissions
If you voluntarily submit a review, testimonial, photograph, video, project story, suggestion, or other content, you represent that:
- You own the content or have permission to submit it;
- The content is accurate to the best of your knowledge;
- It does not unlawfully infringe another person’s rights; and
- Any required relationship or incentive disclosure has been provided.
You grant Flint Hills Barns and Buildings Co. a non-exclusive, worldwide, royalty-free license to store, reproduce, display, adapt, and use the submitted content for website, customer-service, and promotional purposes, subject to applicable privacy law and any separate written agreement.
We may decline, remove, or stop displaying submitted content, but we are not obligated to publish it.
23. Third-Party Links and Services
The website may link to manufacturer websites, product configurators, carriers, financing providers, installers, social-media platforms, or other third-party services.
We do not control and are not responsible for third-party content, availability, security, privacy practices, products, or terms.
A link does not necessarily constitute endorsement of every statement, product, or practice associated with the third party.

26. Limitation of Liability
To the fullest extent permitted by applicable law, Flint Hills Barns and Buildings Co., BJP Stores LLC, and their owners, employees, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages arising solely from use of—or inability to access—the website.
For claims arising from a product or order, liability will be determined by the applicable law, warranty, order documents, product-specific terms, and related policies.
Nothing in these Terms excludes or limits:
- Liability that cannot lawfully be excluded;
- An obligation expressly accepted in writing;
- A valid warranty;
- Liability for fraud or intentional misconduct; or
- A customer’s non-waivable statutory rights.
27. Indemnification
To the extent permitted by law, you agree to defend and indemnify BJP Stores LLC doing business as Flint Hills Barns and Buildings Co. from third-party claims arising from:
- Your unlawful use of the website;
- Content you submit without the required rights or permission;
- Your material violation of these Terms; or
- Your infringement of another party’s rights.
This provision does not require a consumer to indemnify us for our own negligence, misconduct, breach, or violation of law.
28. Suspension and Termination

- Materially violated these Terms;
- Engaged in fraud or unlawful activity;

Electronic acceptance, records, and signatures may be used when permitted by applicable law.
Marketing emails and text messages require any consent mandated by law and may be discontinued using the opt-out instructions provided.
30. Governing Law and Disputes
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.
Before filing a legal proceeding, we encourage you to contact us so we can attempt to resolve the issue directly.
Any legal proceeding will be brought in a court having proper jurisdiction and venue. Nothing in these Terms deprives a consumer of protections, remedies, jurisdiction, or venue rights that cannot legally be waived.
These Terms do not currently require mandatory arbitration or waive participation in a class action.
31. Events Beyond Reasonable Control
Neither party will be responsible for delay or failure caused by circumstances beyond its reasonable control, including:
- Severe weather or natural disaster;
- Fire or flood;
- War, terrorism, or civil unrest;
- Government orders or regulatory action;
- Labor disruption;
- Transportation or carrier interruption;
- Utility or communications failure;
- Material shortages;
- Supplier or manufacturer disruption; or
- Public-health emergencies.
This section does not excuse payment obligations already due or eliminate cancellation, notice, refund, or other rights required by law.
32. Conflicting or Additional Terms
Product-specific terms may appear on a product page, quote, invoice, checkout page, order confirmation, manufacturer document, or separate written agreement.
When disclosed and accepted as part of an order, those terms become part of the agreement.
If product-specific terms conflict with these general Terms, the product-specific terms will control for that order to the extent of the conflict. Rights that cannot legally be waived remain unaffected.
33. Changes to These Terms
We may update these Terms periodically.
Changes take effect when posted on flinthillsbarns.com and apply prospectively. The terms in effect when an order is accepted will generally govern that order unless the parties agree otherwise or a change is required by law.
34. Miscellaneous
Severability
If a provision is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
Assignment
You may not transfer an accepted order or your rights under these Terms without our written consent. We may assign our rights and obligations as part of a merger, sale, reorganization, or transfer of the business, subject to applicable law.
Entire Agreement
These Terms, the applicable order documents, product-specific terms, and incorporated policies constitute the agreement concerning the applicable website use or purchase and supersede prior communications concerning the same subject.
